Period 2: En Route to Pick Up a Passenger

Once the driver accepts a ride request and is en route to the passenger, the rideshare company's $1 million commercial liability policy takes effect. This provides significantly more coverage than Period 1 and applies to injuries sustained by the driver, passengers, and third parties.

Period 3: Passenger in the Vehicle

When a passenger is in the vehicle, the full $1 million commercial policy remains in effect. This is the highest level of coverage and applies from the moment of passenger pickup through dropoff. This $1 million policy includes liability coverage, uninsured/underinsured motorist coverage, and contingent comprehensive and collision coverage.

App Off: Driver's Personal Insurance Only

If the driver's app was completely off at the time of the accident, the rideshare company provides no coverage. The driver's personal auto insurance is the only available policy. This creates a significant coverage gap because many personal policies exclude or limit coverage for accidents that occur during commercial driving activity.

Who Is Liable in a Colorado Rideshare Accident?

Liability in a rideshare accident can involve multiple parties:

  • The rideshare driver: If the Uber or Lyft driver caused the accident through negligence such as distracted driving, speeding, running a red light, or driving while fatigued.

  • Another motorist: A third-party driver who caused the collision. In this case, you would pursue a claim against that driver's insurance, with the rideshare company's UM/UIM coverage as a backup.

Colorado Rideshare Regulations

In 2024, Colorado enacted significant new protections for rideshare drivers and passengers through HB24-1129 and SB24-75, signed into law by Governor Polis on June 5.
